This posting mentions, as I have seen many times before, that "a foreign national is not directly covered by the Bill of Rights and the Constitution". But how can this be if our Constitution is in fact "The Law of the Land"? If I come from a foreign country to visit the United States do I bring my country's own laws with me to have only those laws of my country apply to me OR am I subject to those same laws of the United States that every other citizen and resident is subject to? Clearly, if my feet are on U.S. soil then I am subject to U.S. law and if I am subject to U.S. law then I must also be afforded the same protections and rights enumerated in "the law of the land" document that we call our U.S. Constitution. The notion that Constitutionally protected rights only apply to certain people that are citizens and/or persons that are legally here is completely illogical. It seems clear to me that the "law of the land" would apply equally to all persons on U.S. soil whether here permanently or just passing through.
