Yes, the FBI is Constitutional. Your wrong in your assumption that the FBI is an Agency of Government. The FBI was created administratively within the Justice Dept. and therefor takes its marching orders from within and is an adjunct to the political whims of the justice Dept.
If you look up the creation of the FBI you'll find that its only legislative authority is found within the Fed. Code of Regs. is for the internal investigation within the Fed. Gov. and government entities such as federal lands, military bases, and Fed. Buildings that have been ceded by the various State Legislatures.
In essence there authority lies where Federal Magistrates have authority within the United States District Court. Outside of these areas the FBI is without legislative jurisdiction and is acting beyond its scope. Do one of two things, either make the FBI an agency of government or disband it out of the political arena.
