It’s Easier to Use Law Than the Sword Type Thing
by Mary W Maxwell, PhD, LLB
Some people say the Romans had great law. Nonsense. They were a bunch of bullies. The really great law is American law, based on common law. But it doesn’t work by just sitting on the shelf! You have to use it.
There’s nothing to prevent any adult from trying these items:
1. See a crime? Go to local police station and “lay an information” and carry a copy of it to your local court.
2. See any federal government official doing something harmful? File a lawsuit in any US district court, seeking an injunction of that behavior. The fee is $350, as of 2014 and you can file “in forma pauperis” if you be broke.
3. Demand that charges be brought against anyone who commits perjury in court or by lying to Congress.
4. Been called to jury duty? Enter the courthouse armed with knowledge that one of the legitimate three ways to get a bad law changed is to vote for innocence of someone convicted under a bad law. (The other two methods are to bring a case that challenges a bad law as unconstitutional, and for you to kick the legislators out on Election Day but that has no value if the software allows wrong vote count.)
5. Speaking of that, use Jim Collier’s book, Votescam, to bring to justice all those who do the actual vote-scamming, such as the TV networks. See #1 above.
6. File a lawsuit (again, $350 will do it, and Appeals are a steal at $450) under 42 USC 1983, showing how you have been deprived of a civil right. That covers a lot – recall how the family of OJ Simpson’s ex-wife sued him for damages related to her death even after OJ was acquitted in criminal court. (The term “civil rights” is wrongly thought to be pertinent only in race matters. It was Nicole’s “right to life” that was violated.)
7. The civil rights law at 42USC 1983 has additional provisions for when a person operates under color of law to deprive you of rights, e.g., if police brutalize you. Gotta be worth the $350, and definitely worth an in-forma-pauperis filing for those that qualify.
8. Use the procedure known as petitioning the court for a Writ of Error Coram Nobis, if a decision was reached based on fraud committed by a member of the court (such as the judge, or the clerk of court). You send it to the offending court; it’s not an appeal and has no fee.
9. Request your state legislature to impeach a bad state judge. All other appointed officers are also liable to impeachment. For federal officers, approach your Representative. (Senators can’t impeach anyone.)
10. Use the amazing provision of the RICO Act by filing a civil case (remember $350, cheap) against racketeers or organized crime. You needn’t track down the specific criminals. You must show the pattern of their behavior.
11. Ask your state legislature to hold a hearing on any public issue in their jurisdiction, e.g., 9-11.
12. File a complaint at your state licensing board against any member of the law profession who acts unethically.
13. Ask to have placed under guardianship any leader who is not acting rationally. That will control their property!
14. Request that a court use its prerogative of making a bench warrant for the arrest of a criminal.
15. Bring charges of the crime of assault against an entity that is causing your body to be harmed, such as by geo-engineering or by the production of GMO foods.
16. Note that if you take a swing at one who is about to bodily harm you or someone else, you can be charged with a crime for that, but self-defense (including for another person) acts as an established defense in court.
17. Use, or at least talk about, the Law of Outlawry. It has been around for centuries, and goes like this: There are persons who cannot be captured by cops or by sending them a summons to court. Why not? Maybe the state has run out of budget for hiring cops, or maybe the criminal is so fierce that nobody can touch him. He should then be declared an outlaw, and thus it becomes a crime for anyone to feed him or harbor him.
18. Start a grand jury if your state has usurped that activity.
19. Make a "citizen's arrest" when needed, according to your state's rules. (Read my book; it has a sction on "how to arrest the FBI.")
20. See your legislator killing the Constitution? Charge her with treason, per Article 3.3 of the Constitution, if federal, or under your state’s law.
There are other things you can do that are not in the written law but would reflect your appreciation of the law. For example, you could start a “Hall of Fame” for judges who make great rulings. You can inspect the prisons in your area. See if a publicly-funded law school teaches the law properly. Question the grounds for promotion of US Attorneys.
Find out what the sheriff’s duties are in your county, and consider running for that office yourself. You can start an off-the-books tribunal to judge baddies if there is no way to get the law to do it; give all defendants an opportunity to rebut your evidence.
Wouldn’t it be a pity if we got martial law and then you lost your chance to do these simple things for your kith and kin? Citizens, pleeeease get crackin'.
Note: I permit anyone to hand out copies of the above 20 items. I got most of them from fighters such as Sherman Skolnick and Rodney Stich. Time to pass on this blessing!
