As you may know, this past summer, juror rights educators Mark Iannicelli and Eric Brandt were each falsely arrested for and charged with seven felony counts of so-called "jury tampering" for sharing FIJA's Your Jury Rights: True or False? (.pdf) and Fresh Air for Justice (.pdf) brochures outside the Lindsey-Flanigan Courthouse.

They were in court this morning with defense attorneys David Lane and Lonn Heymann for a pre-trial hearing regarding whether their charges should be dismissed.

WE ARE PLEASED TO ANNOUNCE THIS MAJOR VICTORY!!!

District Court Judge Laff dismissed all of the fourteen charges, seven each against the two defendants, as unconstitutional applications of the law that swept in protected speech. Judge Laff pointed out that if someone was outside the courthouse holding a sign that said "Acquit John Doe", even that would be protected speech.

Despite the charges pending, for months now Eric, Mark, and numerous other brave souls have continued to create more fully informed jurors at this courthouse, to the chagrin of judges and prosecutors! We have been getting reports back about jury trials in this courthouse where judges are finding their panels of prospective jurors with so many who have received FIJA information that it is becoming difficult to impossible to seat a jury without them. Just this morning, Eric informed me that attorneys inside the courthouse are even collecting discarded FIJA brochures inside and returning them to activists outside for reuse.

The balance is tipping toward fully informed juries in Denver, and you can make that happen nationwide!

As I mentioned yesterday, in the coming year I would like FIJA to be able to provide an ongoing supply of free brochures to volunteers at any courthouse where such threats and arrests have taken place for as long as volunteers are conducting outreach there. All incentive to harass juror rights educators in an attempt to quash our message would immediately disappear if such efforts were guaranteed to do the exact opposite and spread the message much further!
